Ballpark landowners to appeal ruling on land value

The owners of the Minnesota Twins ballpark site have decided to appeal their condemnation award of $23.8 million, according to Rich Pogin, a partner in Land Partners II.  

Pogin said the landowners can debunk the county’s case for deductions in the land value based on the condition of the soil. He said he believes they will convince a jury that the base land value is at least $28–$33 million.

Two of three court-appointed commissioners who heard more than four weeks of testimony agreed on an award of $23.8 million. The dissenting commissioner reported that the land value should be $33.18 million.

Pogin said that although the landowners would appeal as soon as Wednesday, they would also propose that the two sides undergo mediation, a non-binding settlement process.

A court date for the pending appeal is scheduled for mid-November, Pogin said.
